TO WHOM IT MAY CONCERN: Below are current public notices of permit applications, notice of individual permit decisions, announcement of public hearings or meetings, and/or rule-making activities. Public comment and participation are encouraged on all of these issues.
The applications described below have been submitted for Aquatic Resource Alteration Permits under The Tennessee Water Quality Control Act of 1977, T.C.A. §69-3-108. In addition, a federal permit may be required from the U. S. Army Corps of Engineers or from the Tennessee Valley Authority under §404 of the Clean Water Act and §26a of the Tennessee Valley Authority Act , respectively. Section 401 of the Clean Water Act requires that an applicant must obtain a water quality certification from the state when a federal permit is required. These notices may cover applications subject to §401 or navigation permitting (Rule 1200-04-08).
No decision has been made whether to issue or deny these permits. The
purpose of these notices is to inform interested parties of this permit
application and to ask for comments and information necessary to determine
possible impact to water quality. Persons wishing to comment on a proposal
are invited to submit written comments to the department. Written comments
must be received within thirty days of the date that the notice is posted.
Comments will become part of the record and will be considered in the
final decision. The applicant’s name and permit number should be
referenced.
The permit application, supporting documentation including detailed plans
and maps, and related comments are available for review and/or copying
at the department’s Natural Resources Section.
Interested persons may also request in writing that the department hold a public hearing on an application. The request must be filed within the comment period, indicate the interest of the person requesting it, the reasons that the hearing is warranted, and the water quality issues being raised. When there is sufficient public interest in water quality issues, the department shall hold a public hearing in accordance with Rule 1200-4-7-.04(4)(f).
In deciding whether to issue or deny a permit, the department will consider all comments of record and the requirements of applicable federal and state laws. In making this decision, a determination will be made regarding the potential lost value of the resource compared to the value of any proposed mitigation. The department shall consider practicable alternatives to the alteration. The department shall also consider loss of waters or habitat, diminishment in biological diversity, cumulative or secondary impacts to the water resource, and adverse impact to unique, high quality, or impaired waters.

NRS08.176 TDOT proposes to widen SR-33 (US-411) from the north city limits of Benton to SR-30 East from a 2-lane highway to a 4-lane highway along the existing alignment. The project would result in the permanent impact of approximately 151 feet of an unnamed tributary to Pell Branch and the filling of approximately 1.12 acres of associated wetland. Applicant proposes to construct two 144.96 ft. X 42.57 ft. one-span concrete girder bridges over Horton Branch, two 142.87 ft. NRS08.163 Silverdale Baptist Church, proposes to relocate approximately 117 linear feet of Friar Branch which would result in 16 linear foot loss of stream channel, also install two sanitary sewer lines under the stream, and a pedestrian walkway crossing over the stream. PH2008-12 The division will hold a public meeting in response to the applicant’s intent to seek permission under the Tennessee Antidegradation Statement to degrade Exceptional Tennessee Waters. The division is seeking public comment on the application by the Giles County Southern Water Authority for a state water quality permit to develop a drinking water source from Richland Creek in Giles County. The meeting will be held on Tuesday September 9, 2008 at 6:00 PM at the Ardmore City Hall, Council Chambers, Mainstreet, Ardmore TN 38449. The hearing is in response to application NRS05.411.
PH2008-013 The division will hold a public hearing to seek comments concerning an application for a state water quality permit. The hearing is in regard to the proposal by the Tennessee Department of Transportation to construct 10.5 miles of State Route 840 from East of Pinewood Rd to West of Columbia Pike. The Public Hearing will be held on Monday, August 25, 2008, 7:00pm at the Leiper’s Fork Community Center, 5325 Old Hwy 96 West, Franklin, TN 37064; (615) 591-9274. The notice for the Public Hearing is in response to application NRS 08.034.
PH2008-14 The division will hold a public hearing to seek comments concerning an application for a state water quality permit. The hearing is in regard to the proposal by the Waste Management, Inc. of Tennessee to eliminate a segment of a surface tributary to facilitate the expansion of the existing Cedar Ridge Landfill. The hearing will be held on Thursday August 28, 2008 at 6:00 PM at the Lewisburg Middle School Auditorium, 500 Tiger Boulevard, Lewisburg, TN 37091. The hearing is in response to application NRS 08.008.

NRS08.034 TDOT proposes to construct 10.5 miles of SR-840 from east of Pinewood Road to west of Columbia Pike in Williamson County impacting 10,816 ft. of streams and 0.173 acre of wetlands. A public hearing shall be held in Leiper’s Fork – see public hearing notice.
NRS08.040 Cedar Creek Apartments LP, proposes to construct a high density residential housing that will require the placement of fill in 1.39 acres of isolated jurisdictional wetlands; Murfreesboro, Rutherford County.
NRS08.101 Joey Sweatman, Kinder Morgan Terminals proposes to dredge accumulated sediments adjacent to the main terminal dock 550 feet long, 50 feet wide, and 15 feet deep to facilitate access of barges to the existing dock during periods of low flow.
NRS08.142 This a second notice to inform the public that the permitting process for ARAP application NRS08.142 has been inactivated. NRS08.142 was also noticed on July 8, 2008 (PN-0852). NRS08.142 is a compensatory mitigation project which is a requirement of Director’s Order WPC08-0055. Since the activity is required by an enforcement action, and the application only proposed the execution of a compensatory mitigation plan and no new impacts, the ARAP application is being inactivated. The original notice of project is as follows: WDW Properties, LLC proposes to provide compensatory mitigation of 1.0 acres for historical alterations to approximately 0.25 acres of wetlands. NRS08.143 City of Johnson City, proposes to construct a structural berm at the Iris Glen Environmental Center to support the previously permitted Cell 6A and expand the landfill. There are 0.3 acres of non-isolated jurisdictional wetlands that will be filled to construct the berm; Johnson City, Washington County.
NRS08.146 Tennessee Wildlife Resource Agency proposes to remove three deteriorating boat ramps and install three new boat ramps to provide boater access on Reelfoot Lake. The ramps are located at Air Park, Champy Pocket Access Area, and Gray’s Camp.
PH2008-011 The division will hold a public hearing to seek comments concerning an application for a state water quality permit. The hearing is in regard to the proposal by the City of Johnson City to construct a structural berm to support the previously permitted Cell 6A and expand the landfill at the Iris Glen Environmental Center. The Public Hearing will be held on Thursday, August 21, 2008, 6:00pm EDT at the Johnson City Power Board Auditorium, 2600 Boones Creek Road, Johnson City, TN 37615; (423) 952-5039. NRS08.128 TDOT proposes to construct approximately 0.20 miles of Cameron Road/Old Walland Highway along a modified alignment with a new 280 ft. 4-span bridge over the Little River at L.M. 0.10. The new construction will consist of two 11 ft. lanes with 3ft. shoulders. Associated with this impact, the applicant proposes to redesign the drainage in an unnamed tributary to the Little River, by replacing the existing 18’ of 12’’ plastic piping, 20’ of 18’’ CMP, 100’ of 12’’ CMP, and 115’ of 8’’ plastic pipe and 139’ of open channel. The hearing is in regard to the proposal by the Cartwright Close, LLC, located south of Hidden Valley Road in northern Williamson County. Proposed is the draining of an existing in-stream pond for the reconstruction 180ft of stream channel. The stream being impacted is a tributary to Cartwright Creek within the Harpeth River Watershed, coordinates 35.997575°N, -86.85907°W. NRS07.068 Master Land Group LLC proposes to dredge approximately 4,000 cubic yards of lakebed material and add riprap to the shoreline on Watts Bar Reservoir in Loudon County.
NRS07.360 TDOT proposes to widen and realign approximately 2.22 miles of U.S.64/SR-40 from east of U.S.411/SR-33 to approximately 1,100 ft. west of the Ocoee River. The project is to widen the existing 2-lane roadway on U.S.64 to a 4-lane divided highway. The applicant proposes the following impacts to aquatic resources:
- The applicant proposes to replace the existing 34 ft. box culvert in Lowery Branch (STR-1) with a 127 ft. box culvert, 40 ft. of rip-rap transitions at culvert inlet and outlet, and 34 ft. of open-channel impact without rip-rap.
- The applicant proposes to replace the 38 ft. existing box culvert in Fry Branch (STR-2) with a 121.5 ft. box culvert, 50 ft. of rip-rap transitions at culvert inlet and outlet, 65.5 ft. of open channel impact without rip-rap.
- The applicant proposes to permanently impact approximately 0.080 acres of the contiguous wetland area (WTL-1) associated with Fry Branch (STR-2), and temporarily impact approximately 0.041 acres.
- The applicant proposes to install a 96 ft. pre-cast box culvert in the unnamed tributary to Fry Branch (STR-3).
- The applicant proposes to permanently impact approximately 0.043 acres of the contiguous wetland area (WTL-2) associated with the unnamed tributary to Fry Branch, and temporarily impact 0.012 acres.
NRS07.385 TDOT proposes to replace three bridge structures over Gulf Fork Big Creek along Old Fifteenth Road, and by doing so, will realign and encapsulate a portion of two unnamed tributaries to Gulf Fork Big Creek. The applicant proposes the following impacts to aquatic resources:
- The applicant proposes to remove and replace the existing steel I-beam bridge structure over Gulf Fork Big Creek at L.M. 9.04 with a 34 ft. reinforced concrete slab bridge and associated rip-rap.
- The applicant proposes to remove and replace the existing steel I-beam bridge structure over Gulf Fork Big Creek at L.M. 9.26 with a 61 ft. reinforced concrete slab bridge and associated rip-rap.
- The applicant proposes to remove and replace the existing steel I-beam bridge structure over Gulf Fork Big Creek at L.M. 9.52 with a 49 ft. reinforced concrete slab bridge and associated rip-rap.
- The applicant proposes to relocate an unnamed tributary to Gulf Fork Big Creek (STR-2) approximately 50 ft. to the east, and by doing so, encapsulate approximately 20 ft. of stream. Additionally, the applicant proposes to construct an approximately 163 ft. rip-rap lined open channel.
- The applicant proposes to relocate an unnamed tributary to Gulf Fork Big Creek (STR-3) approximately 50 ft. to the west, and construct an approximately 209 ft. rip-rap lined open channel.
